These Terms & Conditions (“Terms”) apply to all work undertaken and all invoices issued by Liquid Aspect Waterproofing (“the Contractor”) to any customer (“the Client”). By engaging our services or making payment of an invoice, the Client agrees to these Terms.

- Scope of Work
All work will be carried out in accordance with:
- Australian Standards AS 3740, AS 4654, AS/NZS 4858, and applicable Building Codes of Australia (BCA).
- The specifications outlined in the accepted quotation or purchase order.
Any additional work requested or required outside the agreed scope will be treated as a variation and charged accordingly.

- Quotations and Pricing
- Quotes are valid for 30 days from the issue date unless otherwise stated.
- Prices are based on the information provided at the time of quoting. Any changes to site conditions, access, or materials may affect pricing.
- GST is included unless otherwise stated.
- All materials remain the property of Liquid Aspect Waterproofing until payment is received in full.

- Variations
- Any variation to the original scope must be approved by the Client in writing (email confirmation is sufficient).
- Variations will be charged at standard rates or as quoted prior to commencement of additional work.

- Payment Terms
- Payment is due within 7 days from the invoice date unless otherwise stated.
- Overdue invoices may incur interest at 2% per month, calculated daily until paid in full.
- The Contractor reserves the right to suspend work or withhold warranties if invoices remain unpaid.
- All recovery costs (including legal and collection fees) will be charged to the Client if debt recovery action is required.

- Access and Site Conditions
- The Client must provide safe, clear, and reasonable access to the work area.
- Work areas must be clean, dry, and ready for application. Delays caused by others may incur additional charges.
- Any required power, water, or amenities must be made available to the Contractor at no cost.

- Warranties
- Waterproofing work is warranted for up to 10 years (depending on the system used) from the date of completion, provided that:
- The area is not damaged, modified, or compromised by others; and
- The installation was completed in accordance with manufacturer and Australian Standards.
- Warranty claims must be made in writing and include proof of purchase and site details.
- Warranty does not cover consequential or indirect loss, nor damage caused by structural movement, substrate failure, poor drainage, or misuse.

- Materials and Products
- Liquid Aspect Waterproofing uses approved, compliant products from trusted suppliers.
- Substitutions or specific brand requests must be confirmed in writing before work commences.
- The Contractor reserves the right to make product changes if necessary to maintain compliance or improve performance.

- Delays and Scheduling
- While every effort is made to meet deadlines, delays due to weather, site access, or other trades are outside our control.
- The Contractor will not be liable for costs or damages resulting from such delays.

- Liability
- The Contractor is insured with Public Liability Insurance up to $10 million.
- Liability is limited to the value of the works performed.
- The Contractor will not be responsible for damage to existing finishes, structures, or fittings unless caused by proven negligence.

- Cancellation
- Cancellations within 24 hours of the scheduled start date may incur a call-out or cancellation fee.
- Deposits (if taken) are non-refundable once materials have been ordered or allocated.

- Ownership and Title
- All goods, materials, and workmanship remain the property of Liquid Aspect Waterproofing until payment is received in full.
- The Contractor reserves the right to remove or recover goods or materials supplied if invoices remain unpaid.

- Dispute Resolution
- Any dispute must first be raised in writing within 7 days of the issue arising.
- Both parties agree to attempt to resolve disputes amicably before taking legal action.
- These Terms are governed by the laws of Victoria, Australia, and any proceedings will be heard in a Victorian court of competent jurisdiction.

- Acceptance
By proceeding with the quoted works, signing acceptance, or paying any deposit/invoice, the Client acknowledges they have read, understood, and agreed to these Terms & Conditions.
